When someone else served the alcohol

Georgia’s dram shop law is narrow, but it’s real.

The general rule

In Georgia, someone who sells or serves alcohol can be responsible for injuries caused by a drunk driver only in limited situations, generally:

  • When they knowingly served someone under 21, knowing that person would soon be driving; or
  • When they knowingly served someone who was noticeably intoxicated, knowing that person would soon be driving.

This can apply to bars, restaurants, stores and sometimes social hosts.

What we look for

  • Receipts and tabs showing how much and when
  • Security camera video inside the business
  • Staff and witness accounts of the driver’s condition
  • Whether the driver arrived and left by car
Move fast. Businesses often record over video within days. A preservation letter can stop that.
